Service Description
A pre or post charge program which diverts certain offences away from the court process through a mediation/diversion process often including the victim(if applicable), in an attempt to resolve the crime out of court. If the matter is resolved successfully, the offender will not have a criminal record for the offence. If program is not completed, the matter returns to court for further action. Process includes:
- A mediation meeting between the accused and the victim, a representative appointed by the victim, or a surrogate victim appointed by the agency.
- The accused explaining their involvement and the victim, representative, or surrogate expressing the crime’s impact on them.
- An agreement for settlement that includes one or more of the following:
- restitution/compensation in cash,
- personal service work for the victim,
- community service work,
- cultural/spiritual activities,
- curfew/residency stipulation,
- educational programming,
- formal apology,
- short essay,
- referral to a specialized program,
- referral for assessment/counseling treatment.
Eligibility
Services are status blind and accepts referrals for both Indigenous and non-Indigenous individuals. Referral Criteria includes:
Must be a youth (12 years and older) or an adult,
Must accept responsibility for the offence,
Must agree to participate in the process,
Must not have diverted more than twice in the last 3 years,
Must have no substantial record of similar offence or recent charges.
Individual's who hold a criminal record may still be eligible if there has been demonstrated effort to change their lifestyle prior to the current offence.
The following offences are excluded from the Alternative Measures Program unless an exception is made by the Crown/RCMP:
Use or threatened use of a weapon,
Violence against person offences where the Crown elects to proceed with indictment,
Child sexual abuse cases where the Crown elects to proceed with indictment,
Perjury,
Driving while disqualified,
All alcohol related Criminal Code driving offences,
All family violence cases.
